1. Eligibility and accounts
- You must be able to form a binding contract under the laws of your jurisdiction (typically 18+).
- You are responsible for all activity under your account and must keep your login credentials secure.
- You must provide accurate and complete information when creating your account and keep it up to date.
- You must not share your login credentials or allow unauthorized access to your account.
2. The Service
Pinginn provides tools for monitoring endpoints, tracking incidents, generating reports, and optionally publishing public status pages.
Features may include, depending on your plan:
- Endpoint monitoring (HEAD/GET/POST)
- Configurable intervals, timeouts, and retries
- Incident tracking and historical checks
- Reports, charts, and analytics
- Team features and shared monitors (on applicable plans)
Certain features may be in beta, experimental, or subject to change. We may modify, add, or remove features at any time.
3. Beta access
During private beta, Pro features may be available at no charge to approved users:
- We may limit or revoke beta access at any time.
- Beta features may be less stable and are provided “as is” without any guarantee.
- When beta ends, you may choose to remain on Free or upgrade to a paid plan; your monitors will not be deleted, but may be paused if they exceed Free limits.
4. Plans, pricing, and payment
4.1 Free and paid plans
We currently offer:
- Free: 10 monitors, 5-minute checks, email alerts, 30-day history, and core monitoring features.
- Pro: 50 monitors, 60-second checks, 90-day history, additional features (e.g. Slack, REST API, multi-region checks, status pages, advanced reporting).
- Monitor Pack add-on: +25 monitors for an additional fee per month (stackable).
- Team Pack add-on: Team collaboration features for an additional fee per month.
Details and current pricing are also shown on our website, and may change over time.
4.2 Billing and Stripe
- Paid plans and add-ons are billed through Stripe or another payment processor.
- By subscribing to a paid plan, you authorize us and our payment processor to charge your chosen payment method on a recurring basis (e.g. monthly).
- You are responsible for any applicable taxes, levies, or duties.
4.3 Price changes
Although unlikely, we may change prices and plan features in the future. When we do:
- We will provide reasonable notice for existing paid customers before changes take effect.
- If you do not agree to the new prices or features, you may cancel your subscription before the changes apply.
4.4 Refunds
- Fees are generally non-refundable.
- We may issue refunds or credits at our sole discretion (for example, in case of a billing error).
- Granting a refund in one case does not obligate us to offer refunds in the future.
5. Cancellations and downgrades
- You may cancel or downgrade your paid plan at any time via the Service or by contacting us.
- Unless stated otherwise, cancellations take effect at the end of the current billing period; you will retain access until then.
- If you downgrade to Free while having more than Free’s monitor limit, your monitors will be paused, not deleted. They will automatically re-enable once you are within plan limits.
- We may suspend or terminate your access if you fail to pay fees when due.
6. Your responsibilities and acceptable use
You agree not to:
- Use the Service for any illegal purpose or in violation of any laws or regulations.
- Monitor endpoints or resources that you do not have the right or permission to monitor.
- Use the Service in a way that could damage, disable, overburden, or impair our infrastructure or the infrastructure of third parties.
- Attempt to circumvent rate limits, security safeguards, or access controls.
- Reverse engineer, decompile, or otherwise attempt to derive source code from the Service, except as permitted by law.
- Use the Service for high-risk or life-critical systems where failure or delay of alerts could lead to death, personal injury, or severe environmental or property damage.
You are solely responsible for the configuration of your monitors, alerts, thresholds, and any actions you take based on the data provided by the Service.
7. Your content and monitored data
7.1 Your content
“Your Content” includes data you provide to us, such as:
- Monitor configurations (URLs, headers, request bodies, keywords)
- Status page content (names, descriptions, branding)
- Team information and labels
- Any other data you upload or configure in the Service
You retain all rights to Your Content. You grant Pinginn a worldwide, non-exclusive, royalty-free license to use, host, store, reproduce, and display Your Content as necessary to operate and improve the Service.
You represent and warrant that:
- You have the rights and permissions necessary to use and submit Your Content to the Service.
- Your Content and use of the Service do not infringe or violate the rights of any third party or any law.
7.2 Monitoring data and response bodies
- We store limited monitoring results (e.g. status codes, response times, error messages) and incident data for your use.
- For keyword checks, we may temporarily process HTTP response bodies in memory to look for specific keywords, but we do not store full response bodies in our persistent logs or database as part of normal operations.
8. Third-party services
The Service may integrate with or rely on third-party services such as:
- Your own SMTP provider (email alerts)
- Hosting, logging, analytics, and error tracking providers
Your use of third-party services is subject to their separate terms and privacy policies. We are not responsible for third-party services or how they handle data.
9. Intellectual property
- The Service, including all software, features, design, and content (excluding Your Content), is owned by or licensed to Pinginn and is protected by intellectual property laws.
- You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms.
- You may not copy, modify, distribute, sell, or lease any part of the Service, nor may you reverse engineer or attempt to extract the source code, except as permitted by law.
9.1 Feedback
If you send us feedback, ideas, or suggestions about the Service:
- You grant us a perpetual, irrevocable, worldwide, royalty-free license to use that feedback for any purpose, without obligation or compensation to you.
- We have no obligation to implement any feedback you provide.
10. Service availability and changes
- We aim to provide a reliable Service but do not guarantee uninterrupted or error-free operation.
- Monitoring and alerts may be delayed or fail due to network issues, third-party outages, misconfiguration, or other factors.
- We may modify, suspend, or discontinue the Service (or any part of it) at any time, with or without notice, provided that we will use reasonable efforts not to materially degrade the Service for paying customers without reasonable notice.
11. Disclaimers
To the fullest extent permitted by law:
- The Service is provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied.
- We specifically disclaim any implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade.
- We do not warrant that the Service will be free of errors or that alerts and incident data will always be accurate, timely, or complete.
You are solely responsible for evaluating the accuracy and usefulness of the information provided by the Service and for maintaining your own backup and redundancy strategies.
12. Limitation of liability
To the maximum extent permitted by law:
- Pinginn and any parent company/companies, directors, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, goodwill, or business opportunities, arising out of or related to your use of or inability to use the Service.
- Our total aggregate liability for all claims arising out of or related to the Service or these Terms will not exceed the amount you paid to us for the Service in the 12 months immediately preceding the event giving rise to the claim (or, if you use the Free plan only, USD $0).
Nothing in these Terms limits liability that cannot be limited under applicable law.
13. Indemnification
You agree to indemnify and hold harmless Pinginn and any parent company/companies, directors, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or connected with:
- Your use or misuse of the Service
- Your violation of these Terms
- Your violation of any law or the rights of any third party
- Your Content or monitoring of third-party resources without permission
14. Termination
We may suspend or terminate your access to the Service, with or without notice, if:
- You violate these Terms or applicable law
- Your use of the Service poses a risk to us, our infrastructure, or other users
- We are required to do so by law or by a third-party provider
You may terminate your account at any time via the Service or by contacting us. Upon termination or cancellation:
- Your right to use the Service will cease.
- We may retain certain data as described in our Privacy Policy and as required by law.
- We are not required to refund any fees except where we choose to do so at our discretion.
15. Governing law and disputes
These Terms are governed by the laws of New Zealand, without regard to conflict of laws principles.
You agree that any disputes arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the courts of New Zealand.
16. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will notify you (e.g. by email or a notice within the Service). Your continued use of the Service after the updated Terms become effective constitutes your acceptance of them.
If you do not agree to the updated Terms, you must stop using the Service and cancel any paid subscriptions.
